Copyright Policy
Effective Date: January 1, 2026
At Vignetta, we respect the intellectual property rights of others and expect our users and creators to do the same. This Copyright Policy outlines how Vignetta handles copyright infringement claims on our platform, including our website ( https://www.getvignetta.com/), mobile app, and related services (collectively, the "Service"). It applies to all users, whether you're watching videos, uploading content, or participating in the Vignetta Reward Partner Program. This policy complies with applicable laws, including the Digital Millennium Copyright Act (DMCA) in the United States, and complements our Terms of Service and Community Guidelines.
Our Commitment to Copyright Protection
Vignetta is a storytelling platform for creativity and expression, but all content uploaded to the Service must respect the intellectual property rights of others. As stated in our Terms of Service, you must not upload content (e.g., videos, audio, images, or text) that includes third-party copyrighted material—such as music, video clips, or artwork—unless you have permission from the rightful owner or are legally entitled to use it (e.g., through fair use or fair dealing). If a rightful copyright owner asks us to remove copyrighted material, we will comply.
Submitting a Copyright Infringement Notice
If you believe your copyrighted work has been uploaded to Vignetta without your permission, you can submit a DMCA takedown notice. To be valid, your notice must comply with DMCA requirements and include:
- Identification of the copyrighted work you claim has been infringed (e.g., a link to the original work or a detailed description).
- Identification of the allegedly infringing content on Vignetta, including the specific URL(s) where it appears.
- Your contact information (name, address, phone number, and email address).
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, their agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
- Your physical or electronic signature.
Submit your notice via our online form at our #content-reporting channel on our community Discord or by mail to:
Vignetta Studios
Attn: Copyright Agent
8605 Santa Monica Blvd PMB 574461
West Hollywood, California 90069-4109
Email: vignettasite@gmail.com
We will review and act on valid notices promptly, typically within 3–5 business days, by removing or disabling access to the allegedly infringing content. We will notify the uploader of the removal unless prohibited by law.
Counter-Notifications
If you believe your content was removed in error (e.g., due to fair use or mistaken identification), you can submit a DMCA counter-notification. Your counter-notification must include:
- Identification of the content that was removed, including the URL(s) where it appeared.
- Your contact information (name, address, phone number, and email address).
- A statement, under penalty of perjury, that you have a good faith belief that the content was removed or disabled due to a mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or Los Angeles County, California, if you're outside the U.S.) and will accept service of process from the person who submitted the original notice.
- Your physical or electronic signature.
Submit counter-notifications via our online form at our #appeals channel or by mail to the address above. If valid, we may restore the content within 10–14 business days, unless the copyright owner initiates legal action.
Copyright Strikes
When we remove content due to a valid copyright infringement notice, the uploader may receive a copyright strike. Strikes impact your account as follows:
- First Strike: You'll receive a warning. Restrictions (e.g., limited uploading) may apply for 7 days.
- Second Strike: Additional restrictions, such as temporary loss of monetization (if in the Vignetta Reward Partner Program), may apply for 90 days.
- Third Strike: If you receive three strikes within 90 days, your Vignetta account may be terminated, and all associated content will be removed.
Strikes expire after 90 days, provided no further violations occur. You can appeal a strike at www.spinwit.org/appeals if you believe it was issued in error (e.g., due to fair use or incorrect identification).
Fair Use and Fair Dealing
Vignetta supports creative expression, including uses of copyrighted material that qualify as fair use (in the U.S.) or fair dealing (in other jurisdictions, e.g., the UK or Canada). Fair use allows limited use of copyrighted material without permission for purposes like commentary, criticism, education, or parody, depending on factors such as:
- The purpose and character of the use (e.g., transformative vs. commercial).
- The nature of the copyrighted work.
- The amount and substantiality of the portion used.
- The effect on the market value of the original work.
Fair use is determined on a case-by-case basis, and Vignetta does not mediate disputes. If you believe your use qualifies as fair use, you can submit a counter-notification or seek legal advice.
Repeat Infringer Policy
Vignetta terminates accounts of users who are repeat infringers, in accordance with the DMCA and other applicable laws. If you receive multiple copyright strikes, your account may be permanently terminated, and you will lose access to the Service, including the ability to upload or participate in the Vignetta Reward Partner Program.
Tools for Copyright Holders
Reporting Tools: Use our reporting channel at #content-reporting to flag content that violates our Community Guidelines or this policy.
For Uploaders
Before uploading content to Vignetta:
- Ensure you have all necessary rights for your content, including for music, video clips, images, or other elements.
- If you're in the Vignetta Reward Partner Program, note that copyright strikes may affect your monetization status. Review our program policies here.
- Remove your content if you no longer have the required rights, as outlined in our Terms of Service.
You can manage your content on the app or site, including deleting videos or responding to copyright notices. If your content is removed, you'll receive a notification with details, unless we're legally prohibited from doing so.
